A proposed route to secure compliance with current health and safety legislation.
1. Workplace audit
A workplace audit would normally be carried out first, to ascertain your current level of compliance with health and safety legislation. As a result of the audit, a full report and an action plan can then be produced, in order to target the high risk areas first. An audit normally takes us 1 ½ days, which includes the visit to your workplace and the production of a full report and action plan.
2. Policy*
A health and safety policy and associated material is required under current legislation. This should be a set of comprehensive documents, provided in the form of a manual, which essentially gives you written guidance as to how to manage health and safety in your organisation. The manual must be seen as a document that is used on a frequent basis, as opposed to having one in order to just comply with the law. Policy requirements would be addressed during the audit of your workplace.
3. Risk assessments*
Risk assessments are fundamental in identifying potential problem areas in the workplace. This is the proactive approach and where "suitable and sufficient' risk assessments are carried out, they are extremely effective in rectifying problems before an incident occurs. We can train your staff to do the risk assessments, or we can do them for you.
4. Training*
Health and safety is something that everybody has to be involved in, in the workplace and training will help ensure that everyone in your workforce understands what they are obliged to do to help ensure the health and safety of themselves and others. Importantly, training can be one of the first steps in the development of a positive health and safety culture in the workplace. Training is also a very important element of overall 'competence'. You may have some idea of what training needs you have, or these can be identified by us.
5. Support*
You are required by law to appoint one or more competent persons to assist in the implementation of all aspects of health and safety, and we can fulfil that role for as long as you need us. One key feature of our support is that we spend time helping and developing members of staff, until such times as you have a team of colleagues who have the necessary competencies to move forward with health and safety.
* All the above are a legal requirement, with the exception of auditing. Auditing represents best practice, in accordance with Health and Safety Guidance Note 65 HSG65.
Food safety support and training.
We provide food safety support, both hands-on help and training to all sizes and types of business in the food industry, from multi-national food companies to sandwich shops and takeaways.
We find that many of our clients are so busy that they have not had the time to familiarise themselves with the latest food safety legislation, (Food Hygiene Regulations 2006), let alone ensure that their business is in the hands of a 'competent person'.
That's where we come in and we can provide you with up to date guidance and support to ensure that your business is safe.
Human Resources Advice and Assistance.
6th April 2009 saw the repeal of the Statutory Dispute Resolution Procedures but what does this mean in practice?
Prior to this date employers could find themselves at an employment tribunal purely on the basis that they had failed to follow the correct process as per the Statutory Dispute Resolution Procedures. If the laid down procedure was not followed, this was automatic unfair dismissal. Crazy!
The new legislation aims to give a more realistic, sensible approach to dealing with the resolution of disputes. However, what many employers don't realise is that when the legislation changed a provision was made to allow employees to bring a tribunal claim without having to raise a grievance with their employer first. This takes away the opportunity for the employer to resolve the complaint before finding themselves in a legal situation.
In addition, in line with the changing legislation employers are now required to follow the provisions of a revised ACAS Code of Practice on Disciplinary and Grievance Procedures. Whilst failure to follow this code wont result in an automatic unfair dismissal case, Tribunals will have the ability to increase compensation by up to 25%.
It is therefore important in practice to have guidelines and good processes in your business. Even in cases where you feel that you can handle it correctly because its very clear cut, this may not necessarily be the case.
Employment Law is a specialist area and just like Health & Safety, it needs specific expertise and advice in order to take away the liability of claim to your business.
You are probably not aware whether your processes are reasonable in line with legislation, until such a time that a tribunal claim arrives on your doormat. It is therefore vital to follow good practice and have solid, consistent procedures in your business.
